Rescission occurs mostly in contract disputes, where the court attempts to undo the contract and put all parties back in as close to the same position as they were prior to the making of the agreement. Finally, restitution may be paid as monetary damages, but it is calculated based on the gains of the person in breach and not based on the losses incurred by the person seeking damages. Restitution requires the person at fault to forfeit their gains, and unlike the other civil litigation remedies, restitution can also be granted in certain criminal cases, as well.
