Atlanta Civil Litigation Attorney

When you enter into a contract, accept a job, or enter into any other legal promise, you expect that all other parties involved will do, say, or pay what has been agreed upon. However, when someone does not hold up their end of a legal promise, you have legal options beyond criminal penalties. Civil litigation refers to non-criminal legal disputes where one side seeks money or performance of the legal promise made, and The Solomon Firm can help. Our Atlanta civil litigation attorneys handle a number of different civil litigation matters for our clients and will aggressively fight for your legal rights and remedies under the law.

Civil Litigation Remedies

There are many remedies available in civil litigation, depending on the facts of the case and the outcome desired. The most common civil remedies are damages, specific performance, rescission, and restitution. Damages include payment for compensatory damages and potentially punitive damages. Compensatory damages include general damages for the direct loss and other expenses incurred by the issue as well as any special damages that the parties were aware of at the time the legal promise was made. Punitive damages are awarded in the most egregious civil litigation cases to punish the wrongdoer for their actions and serve as a deterrent to others who may think to do the same.

The next remedy is specific performance, which occurs when the situation is so unique that the only proper solution is to force the party in breach to perform what was promised. This remedy is ordered when money alone cannot resolve the problem. Rescission occurs mostly in contract disputes, where the court attempts to undo the contract and put all parties back in as close to the same position as they were prior to the making of the agreement. Finally, restitution may be paid as monetary damages, but it is calculated based on the gains of the person in breach and not based on the losses incurred by the person seeking damages. Restitution requires the person at fault to forfeit their gains, and unlike the other civil litigation remedies, restitution can also be granted in certain criminal cases, as well.
